    April 9, 2013 (MMD Newswire) -- Imagine a hospital without power for seven months. Imagine a patient with burns on sixty percent of her body. Imagine if you were that patient and that this was the hospital where you were being cared for. This is the reality of medical care in the Njombe Region of Tanzania, Africa, one of the poorest and least developed regions in southwest Tanzania and often referred to as the "forgotten land" by the residents. The villages in this area are all in critical need of local health services, reliable electric power and safe drinking water.

    After visiting this region Lucy Rodriguez was inspired to found Operation Upendo, Inc., an Idaho-based 501(c)(3) nonprofit corporation. Her vision is to provide various aspects of humanitarian assistance to the poor in remote areas of Tanzania.

    The seed for Operation Upendo started in 1997 when Lucy traveled to Tanzania on a vacation. While on safari she observed the magnificent wildlife of Africa, but also became aware of the hardships of the residents. This impacted her life in a profound way. In 2009, she began to realize her dream.

    OPERATION UPENDO  Njombe Region of Tanzania, Africa

    Lucy made three fact-finding trips to Tanzania, two of which included her volunteer medical director. Based on those trips it was determined that the immediate goal should be to rebuild St. John's Hospital, including the provision of reliable electric power.

    Operation Upendo's approach is to provide the training and the means that will make it possible for the people to improve their living conditions and become self-sustaining; a jumpstart rather than endless handouts. Operation Upendo will work with non-government organizations in Tanzania, also known as NGOs, that know what the people of Tanzania need in order to improve their quality of life. However, in many cases these NGOs are unable to progress with their project plans due to lack of financial and/or project support. Operation Upendo intends to select and qualify existing NGOs to work with directly to accomplish its goals.

    Upendo means love in Swahili. Those who join Operation Upendo will become an important part of the organization's core group of volunteers whose mission is to help the less fortunate in Tanzania. But more importantly, they will leave a life-long legacy for generations to come.

    For more information about Operation Upendo please visit www.operationupendo.org. We need the help of people that can volunteer their time to this worthy cause.

    New offering protects budgets and simplifies vendor billing for academic, government and corporate library customers

    Shallotte, NC (MMD Newswire) April 9, 2013 -- WT Cox Information Services today announced a new spend management offering, which enables WT Cox customers to more easily manage literature acquisition spending by providing single-source invoicing for document delivery via Reprints Desk. Academic institutions, government organizations, and corporations use document delivery as a legal method for retrieving single copies of full-text papers from scholarly peer-reviewed journals when subscription access does not exist and as a supplemental alternative to interlibrary loan (ILL).

    WT Cox subscription customers who activate this option will set up a vendor account with Reprints Desk, but instead of receiving a monthly invoice from Reprints Desk and paying Reprints Desk independently, WT Cox customers will be billed by WT Cox and submit payment to WT Cox using their established systems and workflows.

    "Providing Reprints Desk services directly to WT Cox customers is beneficial in that our libraries can now create a deposit account and access document delivery services all within their existing payment methods. As an information partner, this is another important service that we can offer our customers to save their library time and money," said Michael Markwith, Vice President of Sales and Marketing.

    WT Cox is a full-service serials and information services provider, serving academic, corporate, special, government, school and public libraries nationwide. WT Cox offers a portfolio of services that include electronic and print subscription access, eBooks, ERM solution, discovery tool, online serials management tools, personalized services, transitions coordinators and free service proposals.

    Reprints Desk has held lone honors as the top-rated document delivery supplier in every document delivery market research survey conducted by information analyst and advisory firm Outsell, Inc. since 2008. Reprints Desk recently announced the release of its new academic document delivery

    collection service featuring special academic pricing. The company also launched its new article-level Open Access (OA) Filter in March 2013, which helps customers to dramatically reduce document delivery spending by processing all orders through Reprints Desk's proprietary OA Filter before being processed as an external document delivery fill.

    Los Angeles, California (MMD Newswire) April 11, 2013 -- President Obama said in his April 2nd speech "We have been a nation of dreamers and risk-takers; people who see what nobody else sees sooner than anybody else sees it. We do innovation better than anybody else -- and that makes our economy stronger. When we invest in the best ideas before anybody else does, our businesses and our workers can make the best products and deliver the best services before anybody else."

    Babak Kateb, founding Chairman of the Board of SBMT, attended the White House event at which President Obama announced a new federal effort to fund research that will constitute a major new Brain Mapping initiative. The SBMT Board of Directors had previously submitted a white paper to the White House and is part of the national dialogue about President Obama's Brain Mapping Initiative.

    April 16, 2013 (MMD Newswire) -- "People's Omnibus" is the first project ever that makes social research available for everyone. This will be a statistical picture book that answers all your questions on the chosen topic.

    'People's Omnibus' provides a new approach towards popular science. Its team wants to conduct professional social surveys on topics and questions provided by its audience. The topic might be a country or some social issue, and hundreds of people will be interviewed to answer the questions.

    Igor, the project leader, wants to share how social science is interesting and helpful: "For me the most interesting thing in the world is trying to understand the human being. And the People's Omnibus is a great project towards such comprehension."

    ''People's Omnibus'' is going to discover the World with you and Kickstarter    ''People's Omnibus''

    For the first experiment Russia was chosen as the topic, as the team has everything needed to guarantee high quality of project's results. For those who have any interest in Russia - that's a chance to ask those strange Russians anything and to understand them a bit more.

    If you have no interest in Russia at all - just imagine. Would you find such project interesting if it was about another country? USA? Japan? Australia? If the project is successful - People's Omnibus claims to try launching similar project for other countries as well.

    Got interested? Check People's Omnibus Kickstarter page and support them: http://www.kickstarter.com/projects/rakudajin/peoples-omnibus-russia

    More details on "People's Omnibus: part 1 - Russia":

    The idea of the project is in allowing people to ask their own questions:

    - Backers - ask any questions they want.

    - People's Omnibus team - interviews 600 people via professional online survey, process and analyze the answers.

    And then there comes a book with your questions and gathered answers, where all the participants are shown as co-authors of this book.

    So here are two basic ways for people to take part:

    - Get a book - either PDF version (5-8$), or a paperback one (21$);

    - Ask a question (60$+).

    The book will consist of at least 40 questions: 5 basic questions + 1 question for every 20 books ordered (both digital and paperback count) + all the questions added directly by backers via 'The Question' pledge. So the more questions are asked the more books are ordered - the better the book will be.

    The question might cover any topic:

    - Lifestyle and habits;

    - Politics and economics;

    - Games and entertainment;

    - History and culture;

    - Psychology (including complicated questions);

    - Opinion towards your hobby or interest;

    - Anything else.

    Project team will use one of the greatest Russian internet-survey panels, which is used by most of professional research companies. And it is capable of representation of all the internet users of Russia - males & females, young & old, rich & poor, those who live in Moscow & those who live in a village in Siberia (in case he/she has connection to the Internet).

    The questions already submitted vary from "What is your opinion towards Russian opposition?" to "Where have you ever seen a bear?". If you want to support the project and submit your own question, join the project here: http://www.kickstarter.com/projects/rakudajin/peoples-omnibus-russia

    Precedent setting legal case sends strong message about intimidation and suppression of expert witnesses, and could help end the "White Coat of Silence"

    Philadelphia, Pennsylvania (MMD Newswire) April 16, 2013 - It has been a long road to justice for Dr. Steven R. Graboff, a board certified orthopaedic surgeon who for the past 20 years has also been a highly regarded expert witness in hundreds of medical malpractice, wrongful death, personal injury, civil, and federal cases. In April of last year Dr. Graboff won a precedent setting defamation claim against the American Association of Orthopaedic Surgeons and the American Academy of Orthopaedic surgeons, collectively known as the AAOS, and a law firm whose actions resulted in Dr. Graboff's wrongful suspension from the AAOS. After a jury awarded Dr. Graboff $392,000, the AAOS filed a post trial motion to set aside the verdict. But on March 28, 2013, the Honorable Judge Joel H. Slomsky of the United States District Court for the Eastern District of Pennsylvania denied the AAOS' motion, upholding the verdict and, says Dr. Graboff, restoring the doctor's own reputation and credibility as an expert witness.

    Dr. Graboff sees this latest ruling not only as professional and personal vindication but also as a stern and powerful message that expert witnesses cannot be intimidated and silenced. He says, "There is no place in our justice system for witness intimidation practices, such as that which is instituted and used by the AAOS to control its member physicians - and which in turn strengthens the 'White Coat of Silence.'"

    The "White Coat of Silence" refers to the reluctance by all too many physicians to testify against other physicians in medical malpractice cases, or even to report unethical, incompetent, or dangerous colleagues. As Dr. Graboff has learned the hard way, it's not easy being a medical doctor who is willing to testify on behalf of medical malpractice plaintiffs. Doctors who speak out for malpractice victims may face repercussions not only from their fellow physicians but also from their respective medical societies.

    Dr. Graboff's saga began a few years ago when he was retained by a Philadelphia medical malpractice law firm to provide expert witness testimony for one of their clients. He prepared a draft of a report, based only upon initial information the firm had given him, and clearly labeled the report as such. However, the law firm whited-out the word "DRAFT" and submitted the documents to the defendants as final. Dr. Graboff's preliminary opinion suggested that the doctor being sued had violated the standard of care in treating the plaintiff; as a result, that doctor filed a grievance with the AAOS, stating that Dr. Graboff had violated the Association's Standards of Professionalism regarding expert witnesses. Dr. Graboff was suspended from the AAOS in June 2009 for 2 years, and the Association publicly listed his suspension on their web site and online newsletter, AAOS NOW. Due to the way the listings were worded, the exposure resulted in significant questioning of Dr. Graboff's reputation, as well as a significant loss of income.

    He filed a defamation claim against the AAOS and also filed suit against the law firm that had wrongfully turned over his draft report to the defendants (United States District Court for the Eastern District of Pennsylvania Civil Action No. 10-1710). The 2012 verdict in Dr. Graboff's favor was significant because his attorney, Clifford E. Haines of the Philadelphia firm Haines & Associates, argued that the expert witness program developed by the AAOS was intended to silence doctors who testify against other doctors. This, Mr. Haines explained, was the AAOS' way of handling the medical malpractice insurance crisis.

    The jury apparently agreed with Mr. Haines' argument.

    Said Mr. Haines after the verdict was delivered, "This case was really about standing up for the rights of medical expert witnesses and the patients for whom they testify. I believe that medical associations like The American Academy of Orthopaedic Surgeons (the AAOS) are going after doctors who help prosecute a patient's claim of medical malpractice. The principle we're fighting against -- the silencing of doctors - is why we took on this case." http://www.mmdnewswire.com/dr-steven-graboff-md-wins-lawsuit-aaos-and-colleran-firm-108119.html

    Dr. Graboff says, "My legal team and I believe that my initial lawsuit against the AAOS, the jury verdict against the AAOS, and the Judge's ruling defeating the AAOS' attempt to overturn the verdict have been a precedent setting series of events. As far as I know, I am the first doctor to win a case like this against a large and prestigious medical society."

    In his March 28, 2013 opinion upholding the verdict, the Honorable Judge Joel H. Slomsky wrote that it was evident that the AAOS has "intruded itself into the marketplace of orthopaedic surgeons who earn a living testifying as experts..."

    Judge Slomsky added that the AAOS' Standards of Professionalism are all encompassing and written in such a broad manner that virtually anything an expert witness says or does is subject to AAOS review. He wrote, "The AAOS is well aware of its clout in the profession of orthopaedic surgeons and created its compliance program and standards to control the occupation of its members as experts. [The AAOS] is also aware that its enforcement program and standards would affect the income of doctors because the loss of AAOS accreditation has a substantial impact on the ability of an expert to work in that industry...the evidence shows that the intrusion of the AAOS into the marketplace of expert orthopaedic surgeons is substantial and jeopardized Dr. Graboff's source of income as an expert."

    The Court's March 28 opinion and order to deny the post trial motion can be viewed in full here: http://ia801607.us.archive.org/4/items/gov.uscourts.paed.354973/gov.uscourts.paed.354973.169.0.pdf

    An article by Mary Ann Pazanowski in the Bloomberg Bureau of National Affairs (BNA) "Health Law Reporter" (4 April 2013) concurs that Dr. Graboff's case is an unusual and significant one. The article explains how Dr. Graboff's case illuminates the sometimes-oppressive clout that organizations such as the AAOS have over their membership in regards to expert witness testimony. This scrutiny of expert witnesses by professional organizations short-circuits the judicial system. The Bloomberg BNA article on Dr. Graboff's case can be read here: https://docs.google.com/file/d/0B3nvxHb2xXaUZXlLSE1pTm9UeW8/edit?usp=sharing

    For his part, Dr. Steven Graboff says he is relieved that his good name, reputation, and credibility as an orthopaedic expert witness have been restored. He notes, "What Judge Slomsky's ruling indicates is that the AAOS has been found guilty by the Court of knowingly publishing information on the Internet publicly that portrayed me in a false light, and that knowingly would have a substantial impact on my practice as an orthopaedic surgeon expert witness. The jury's original verdict and the Court's subsequent ruling vindicate me. And even more importantly, I believe that the verdict and ruling represent a victory for everyone for whom the pursuit of justice depends upon the testimony of an expert witness."

    Arequipa, Peru (MMD Newswire) April 17, 2013 -- Gold Horizons Mining Co. Ltd. (ticker GHMG on GXG markets) continues to explore and develop the Blanca Vein in preparation for its Yuromayo processing plant, which is scheduled to start production in the coming months. The 11th of February saw the company receive its highest assay results to date. We took several samples and the results can be seen in the attached document. In the lower Blanca tunnel, sample MN13003856 we received 10.33 grams per ton. In the Blanca upper tunnel, sample MN13003858 we received 12.30 grams per ton. We have come to expect at least 10 grams per ton from the Blanca vein given the entirety of past assay results. We were not, however, expecting nor were we prepared for the sampling results in the lower Blanca tunnel (20 meters down the shaft) on the two new fronts. These results far exceed our expectations with sample MN13003857 reporting 78.37 grams per ton and sample MN 13003858 reporting 97.15 grams per ton. We will continue to exploit this area mining several tons of ore per day to better confirm the average grade per ton numbers. After crushing and milling several hundred tons of this mineral we will report back with a more conclusive overall gram per ton average.

    Patent for Breakthrough Brain Treatment Wins 2012 Edison Patent Award

    March 21, 2013 (MMD Newswire) -- US Patent 8,088,091 "No Clog Shunt Using a Compact Fluid Drag Path", which was drafted and prosecuted by the patent firm Gearhart Law, was granted on January 3, 2012 by the United States Patent and Trademark Office to NJIT researchers Professor Reginald Farrow and Professor Gordon Thomas. Carl Georgeson, also at NJIT, managed the transfer of information between the professors and Gearhart Law and worked with Gearhart Law to facilitate the patent process. The researchers won a prestigious Edison Patent Award for the patent.

    The Edison Awards are named after the most prolific American inventor of all time, Thomas Alva Edison. He obtained 1,093 US patents throughout his lifetime, and improved and modernized American life with his inventions. Among his most famous inventions are the light bulb and the phonograph. The Edison Awards recognize and reward innovators who, similar to Edison, improve lives with their innovations.

    The patent that received the Edison Patent Award was for an improved method of removing excess fluid from the brain. Current technology uses shunts; unfortunately, shunts have a finite lifetime because they rely on holes that get clogged with body matter over time. US Patent 8,088,091 details innovative improvements in shunt technology that will aid patients who rely on shunts. The new technique reduces the need and frequency of invasive procedures by reducing clogging of the shunt and thereby increasing its lifetime. Most drainage systems have also relied on filters outside the brain but inside the skull. The new technology described in the patent uses an extracranial filter as opposed to older methods which used intracranial filters, meaning the physician no longer has to invade the skull to change the filter. The filter resides under a thin layer of skin which is easily opened when the filter needs replacement. Monitoring the flow of brain fluid is a crucial part of the process, and has been made less invasive in this new technology by using wireless methods to monitor flow and pressure of the brain fluid.

    Gearhart Law was honored to work with NJIT and their researchers, who are on the cutting edge of developing new technologies to improve peoples' lives.

    New York, NY (MMD Newswire) March 29, 2013 -- American Corporate Partners (ACP), a national nonprofit organization that connects post-9/11 veterans to business professionals for career guidance, is pleased to announce that General David H. Petraeus has joined its Advisory Council.

    Petraeus joins the following distinguished ACP Advisory Council Members: Diane Bodman, Richard Danzig, Robert J. Dole, Christine A. Ferer, Dr. John J. Hamre, John P. Havens, Karen Hughes, Jack H. Jacobs, Vernon E. Jordan Jr., John M. Keane, William Kristol, Mary Jo Myers, Richard B. Myers, Lynne Pace, Peter Pace, Dennis Ross, James A. Runde, Peter J. Schoomaker, Henry Hugh Shelton, George P. Shultz, Lawrence H. Summers, and Paul Wolfowitz.

    General David Howell Petraeus served more than 37 years in the U.S. Army, retiring as a four-star general in August 2011 to become the director of the CIA. In his final years in uniform, Petraeus led the "surge" in Iraq from 2007 to 2008, commanded U.S. Central Command from late 2008 to 2010, and commanded international forces in Afghanistan from 2010 to 2011. He then served as director of the CIA for 14 months.

    David Petraeus grew up in Cornwall-on-Hudson, New York and graduated with honors from the U.S. Military Academy at West Point in 1974. A graduate of the U.S. Army Command and General Staff College (1983), he also earned advanced MPA and Ph.D. degrees in international relations (1985, 1987) from Princeton University's Woodrow Wilson School of Public and International Affairs. He later completed a fellowship at Georgetown University's School of Foreign Service (1995).

    Petraeus was deployed for nearly 7 of the 10 years that followed the 9/11 attacks. He served in Bosnia from 2001 to 2002 as the chief of the NATO forces operations there. He subsequently led the 101st Airborne Division in the 2003 attack on Saddam Hussein's regime in Iraq and then moved the division north, where it spent the remainder of the first year of Operation Iraqi Freedom. Shortly after returning to the United States, he returned to Iraq briefly to assess the Iraqi Security Forces and then for 15-1/2 months to establish the multi-national and NATO commands that were charged with the recruiting, training, and equipping of the new Iraqi military and police forces and their respective ministries. Petraeus returned to the United States in the fall of 2005 and took command of the U.S. Army headquarters that oversaw 17 different Army schools and centers, a position from which he directed the development of new strategies for counterinsurgency operations. Petraeus returned to Iraq in early 2007 to take command of the Multi-National Force-Iraq, the position from which he led the so-called "surge" in a new strategy against the insurgents and militia extremists that were responsible for a horrific escalation in violence in Iraq. Over the subsequent 19-1/2 months, violence was reduced by some 90%. He left Iraq in the fall of 2008 and became commander of the U.S. Central Command, overseeing operations in the Middle East and Central Asia. In late June 2010, he was selected to become commander of U.S. and international forces in Afghanistan, and he served in that post until July of 2011. Following his retirement from the military, he was sworn in as director of the CIA, a position he held until November 2012.

    ARLINGTON, TX (MMD Newswire) March 29, 2013 -- The Papa John's Rangers7 promotion is back for a third season with 50% off savings for fans ordering online any day after the Texas Rangers score seven or more runs in a game. Started in 2011, Rangers7 has enjoyed tremendous success over the past two years and this season, Papa John's is launching the signature promotion with a new TV spot airing Sunday during the Rangers opening game against the Houston Astros.

    "We couldn't be more proud, or more excited to be working with the Texas Rangers for a third season," Steve McNeil said, Papa John's Operations Vice President. "Everyone in the organization has been fantastic and we think our new spot will showcase the outstanding partnership we share with them."

    Created by Dallas' The Loomis Agency, the new commercial called "Whisper" is a heartfelt homage to the 1989 baseball classic, "Field of Dreams." In the spot, a group of players are taking batting practice at night when a mystical voice tells them, "If you score 7, they will come." Confused, the batter, played by former Texas Ranger Kevin Mench, asks the pitcher if he said something. When the pitcher says no, the voice repeats, "If you score 7, they will come." As the bewildered players look to center field for the source of the voice, a lone Papa John's delivery guy emerges from the bullpen in wonder of where he now finds himself. Upon seeing him, and the army of Papa John's delivery people behind him, the batter and pitcher repeat the voice's promise as they suddenly understand the cryptic message. At the end of the spot, the origin of the voice is revealed as Papa John's founder and spokesperson, "Papa John" Schnatter, turns to camera and whispers Papa John's classic tagline, "Better ingredients. Better pizza. Papa John's."

    "Rangers7 has been an incredibly effective promotion over the past two years, but until now, it's all come through a presence at the Ballpark and fan buzz on Facebook and Twitter," Michael Tuggle said, LOOMIS Executive Creative Director/Writer. "This season, we wanted to come out of the gate strong with a TV spot that embraced not just the spirit of the promotion, but also the spirit of the game."

    Creative Director Cecily Worthy, who art directed the commercial, agrees. "We knew the spot would be running throughout the season so we tried to make a commercial people would look forward to seeing from April to October. We're really excited about how the spot turned out," Worthy said.

    To take advantage of Rangers7, fans simply have to place their Papa John's order online at papajohns.com and enter the promo code "Rangers7" the day after the Rangers score 7 or more runs in a game, win or lose. In 2011, the Rangers accomplished that feat 58 times on the way to their second consecutive American League Pennant. In 2012, they scored seven runs or more 43 times.

    Headquartered in Louisville, Kentucky, Papa John's International, Inc. (PZZA) is the world's third largest pizza company. For 11 of the past 13 years, consumers have rated Papa John's No. 1 in customer satisfaction among all national pizza chains in the American Customer Satisfaction Index (ACSI). Papa John's also earned the 2012 Harris Poll EquiTrend® Pizza Brand of the Year. Papa John's is the Official Pizza Sponsor of the Texas Rangers.

    The Mendelssohn heirs base their claim upon well-developed historical facts, the bona fides of which the federal court in Manhattan credited several years ago in a closely related case. See Julius H. Schoeps, et al. v. Museum of Modern Art, 594 F. Supp.2d 461, 466 (S.D.N.Y. 2009).

    1. Paul von Mendelssohn-Bartholdy's loss of Madame Soler due to Nazi persecution

    The Nazis took power in Germany on January 31, 1933 with a transparent agenda to exclude Jews - and Jewish banks and bankers especially - from the economy of Germany and to compel them to forfeit their property. Paul von Mendelssohn-Bartholdy was an immediate target of the Nazi regime given his prominence, wealth and social standing. The Mendelssohns were Germany's most prominent Jewish family. The famous composer Felix Mendelssohn was a family member, as was Enlightenment philosopher Moses Mendelssohn. Mendelssohn & Co. bank, established in 1795, was one of the five largest private banks in Germany.

    By October 1934, Nazi policies and predation had obliterated the value of Mendelssohn-Barthtoldy's 22% equity interest in Mendelssohn & Co., causing his income to plummet from about 430,270 RM in 1932 (the year before the Nazis took power in January 1933) to only 59,374 RM in 1934. So in less than two years Nazi policies had diminished Mendelssohn-Bartholdy's income by a staggering 86%. In 1934, Mendelssohn-Bartholdy's annual alimony expense alone more than doubled his diminished income. By negating the value of Mendelssohn-Bartholdy's primary asset, Nazi policies and pressure compelled him to seek liquidity from alternative sources.

    Mendelssohn-Bartholdy's superlative private art collection, established over many years beginning in the early 1900's, was one of his most significant assets and represented the only source of liquidity available to him to respond to his escalating negative cash flow deficit. Mendelssohn-Bartholdy's collection was comprised of about 60 master works by luminaries such as Picasso, van Gogh, Braque, Monet and Renoir, among others.

    Between September 1933 and February 1934, Nazi persecution compelled Mendelssohn-Bartholdy to sell or consign some 16 of these master works - including Madame Soler - having never even attempted to sell a single major artwork in the previous 25 years. The Mendelssohn heirs maintain that the loss of Madame Soler represented a signal milestone along a path that Nazi authorities meticulously engineered to marginalize Jews and deprive them of their property which facilitated later mass genocide.

    2. Bavaria's 1964 purchase of Madame Soler in New York

    In 1964, the Bavarian State Paintings Collection ("BSPC") purchased Madame Soler in New York City from art dealer Justin Thannhauser who had taken possession from Mendelssohn-Bartholdy in 1934. Former Nazi party member and the incoming director of the BSPC Halldor Soehner represented Bavaria in the purchase. Even though Soehner knew that Mendelssohn-Bartholdy had owned Madame Soler - and was expressly aware of the painting's "Jewish Provenance" - he failed to ask Thannhauser the reasonable questions that the circumstances demanded: From whom did Thannhauser acquire Madame Soler? When did Thannhauser acquire it? What, if anything, did Thannhauser pay for it?

    3. Bavaria's current refusal to restitute Madame Soler, or even to apply to this claim its own prescribed criteria for Holocaust era restitution cases

    In 2009, the Mendelssohn heirs sought restitution from the BSPC for Madame Soler. Notwithstanding its awareness of the clear evidence of a forced transfer from Mendelssohn-Bartholdy set forth above, the BSPC refused the exhaustively documented claim of the Mendelssohn heirs to return Madame Soler. Moreover, the BSPC failed to apply to this claim the criteria that it and other German states had specifically prescribed to resolve such controversies and which were expressed in a Common Statement as well as related Guidelines. In addition, the BSPC refused the request of the Mendelssohn heirs to submit their claim to the German Limbach Commission, which the German federal government and its constituent states established specifically to hear claims for the recovery of Nazi era artworks and to decide these claims in a non-binding, equitable and fair manner. Accordingly, the BSPC gave the Mendelssohn heirs no option but to file suit in New York to reclaim the painting.
